FAQ

Founder questions

I incorporated federally. Isn't my name protected?
Incorporation gives you the right to use that corporate name. It does not stop someone else from registering a confusingly similar trademark, and it does not give you the right to stop them from using a similar brand. A trademark registration does. They are different systems with different registries.
What if the name is not clear?
Then you find out now, for the price of a Kickoff, instead of after you have printed packaging and bought ads. The report will explain the problem and, where possible, suggest how to adjust the mark or the classes to reduce risk.
Do I need this if I already did a NUANS search?
A NUANS report is designed for corporate name approval and includes a basic trademark check, but it does not assess registrability or likelihood of confusion the way an agent does. Many founders are surprised by what a proper trademark search turns up.
What does the filing cost after the Kickoff?
Our standard filing package covers one mark in up to two classes, with CIPO's government fee billed separately. Your Kickoff report includes the exact quote for your situation, and the Kickoff fee is credited if you proceed within 30 days.
Can you do the Kickoff before I incorporate?
Yes, and it is often the best time. Clearing the brand name first avoids picking a corporate name you cannot build a brand on.
