Filing questions

How long does registration take in Canada?
CIPO's examination timelines have improved but registration still commonly takes well over a year from filing. The good news is that many of the practical benefits, including Amazon Brand Registry enrolment and your priority date, start at filing.
What are the government fees?
CIPO charges its online filing fee for the first Nice class and a smaller fee for each additional class, adjusted annually. These are separate from our professional fee and passed through at cost. We show you the exact CIPO amount in your quote.
Word mark, design mark or both?
A word mark protects the name in any font or styling and is usually the stronger first filing. A design mark protects a specific logo. Brands with a distinctive logo often file both, but if budget is tight the word mark almost always comes first.
What happens if CIPO objects?
You receive an Examiner's Report and we respond to it. Because we drafted the application, we know the file and can price the response fairly. Many objections are avoided entirely by drafting the goods and services properly the first time, which is a large part of what you are paying for.
Should I do a full search first?
The filing package includes a knockout search for direct hits. A full clearance search goes further, looking at similar marks, common-law use and business names, and gives you a written risk opinion. It is worth it when the brand investment is significant or the name is anything other than clearly unique.
