What exactly is an Examiner's Report?
It is CIPO's formal letter listing why your application cannot be approved as filed. Common objections include confusion with an earlier mark, a name that is considered descriptive, or goods and services that are not described in acceptable terms. It is not a rejection. It is an invitation to fix or argue, and it comes with a deadline.
How long do I have to respond?
The report states your deadline, typically six months from the report date. If you miss it your application is treated as abandoned, though a short window may exist to reinstate. Send us the report as soon as you can and we will confirm the exact date on the file.
Which tier will I need?
You do not have to guess. Send the report and we assign the tier. Simple covers a single narrow objection such as goods and services wording. Standard is the typical first report with a confusion or descriptiveness objection that needs a real argument. Complex covers multi-issue reports, evidence-based arguments, or a prior response that did not work.
Is there a CIPO fee to respond?
Not for a standard response. If you need an extension of time, CIPO charges a fee for that, which we pass through at cost. Our tier quote covers the professional work.
What if CIPO issues another report after our response?
Sometimes an examiner maintains an objection or raises a new one. Subsequent reports on a file we are already handling are quoted at a reduced fee, since we already know the file.
Can you guarantee the application will be approved?
No one honestly can. What we can promise is a properly prepared response, filed on time, reviewed by our team, and a candid assessment up front if we think the odds are poor. If we do not believe a response is worth your money, we will tell you before you pay.
I already missed the deadline. Is it over?
Not necessarily. Depending on how recently the deadline passed, there may be a path to reinstate, or a refile strategy that keeps your priority position as strong as possible. Contact us with the dates and we will lay out the options.
